Conditions of Sale

These Conditions of Sale apply to auctions hosted by Propeller Enterprises ("Propeller") through the website www.propeller.la (the "Site"). Propeller Enterprises and the Donor's entire agreement, in addition to the Terms of Use for the Site, with the Bidder in regards to the item listed are outlined and established in the following.

The Conditions of Sale and all other content related to this item are subject to change. Items are offered by Propeller as agent for the Donor, unless otherwise noted.

By submitting a bid and/or participating in any auction on Propeller, you acknowledge that you, the Bidder, are bound by these Conditions of Sale.

1. Item Condition

All items are sold as is. Neither Propeller nor the Donor offer any representations or warranties as to the condition of the item and no statement made anywhere can be considered such a warranty or representation. Propeller and the Donor also make no representations and warranties, express or implied, as to whether the purchaser acquires any copyrights, including but not limited to, any reproduction rights in any item.

We and the Donor are not responsible for errors and omissions on Propeller.la or any other material. Propeller is not responsible for any damage to an item, regardless of cause. All sales are final.

2. Item Assessment

The Bidder should thoroughly assess the item listing before bidding to determine its condition. If that information is not available on the site, Bidder assumes the responsibility of contacting Propeller for additional details.

Each Bidder's decision to bid and determination of their bid and maximum bid amounts should be based upon their own assessment of the item(s) in question. In any purchase or sale, the estimated value of the item(s) is reflected by the price. The Bidder assumes all risks of valuation concerning any and all purchases.

3. Item Withdrawal

Propeller reserves the right to withdraw any item at any time and shall have no liability for doing so.

4. How Bidding Works

A. Entering a Bid

To enter a bid on an item Bidder will need to be logged into their Propeller account, or create one if they do not have one already. Once the Bidder's account has been created and credit card details added to their profile, Bidder will be able to make a bid on an item. By making a bid Bidder agrees to the Conditions of Sale.

Bidder may bid at or above the starting bid displayed as the "Current Price" for the item. If the status of the bid changes, Bidder may receive notifications via email and Bidder's user dashboard on the Propeller website.

You must be at least 18 years of age to enter a bid.

B. Cancelling a Bid

A bid is submitted after Bidder places and confirms their bid amount. Bidder agrees that all bids submitted are final.

Neither Propeller nor the Donor is responsible for any errors in bidding. It is the Bidder's responsibility to bid on the correct item. The Bidder should make sure the bid price they enter is the price they are willing and able to pay. Once the auction has ended and Propeller has announced the winning Bidder, that Bidder is unconditionally bound to pay for that item, even if the Bidder has made an error.

C. Fraudulent Bids

Propeller reserves the right to exclude any person, at its sole discretion, from the auction.

If an entity places a bid, then the individual placing the bid on behalf of the entity agrees to personally guarantee payment for any successful bid.

Any Bidder that represents a purchaser is personally and individually responsible for any obligations of the purchaser set forth in these terms and conditions. A valid resale license and appropriate documentation from the purchaser will be necessary for the removal of state sales tax.

D. Winning Bids & Disputed Bids

The successful Bidder is the highest Bidder confirmed by Propeller. In the event of any dispute between Bidders, or in the event Propeller has questions or concerns about a bid, Propeller will have final discretion in determining the winning Bidder. Propeller also reserves the right to either re-offer or resell the item in question. If a dispute arises after the sale, Propeller's sale record is conclusive.

By accepting the Conditions of Sale, Bidder personally and unconditionally guarantees payment.

Title to any item remains with the Donor, any secured party of the Donor, or assignee of Donor, as the case may be, until the item is paid for in full by the Bidder. Propeller reserves the right to require payment in full before delivering any item to the successful Bidder.

5. Maximum Bids

A maximum bid is an amount the Bidder enters, known only to the Bidder, that represents the maximum amount Bidder is willing to bid. It is higher than the current price and also higher than the next allowable minimum bid amount. If Bidder enters a maximum bid, the system will automatically bid on Bidder's behalf up to that maximum bid amount in response to other bids.

The value and status of your maximum bid will be visible only to the Bidder, unless it is the current leading bid.

6. Refunds

Refunds are rewarded on a case by case basis and at the sole discretion of Propeller Enterprises.

7. Unpaid Items

When a Bidder wins an auction on Propeller they are obligated to complete the purchase by sending full payment to the Donor. Bidders must pay for the item on Propeller within 4 calendar days. If the Bidder doesn't pay within this timeframe, the Donor and/or Propeller can cancel the order and the unpaid item will be recorded on the Bidder's account.
